Terms of Service

This document is a working template and not yet finalized by counsel. It is provided for transparency about our intended terms. The binding agreement for your account is the one executed during onboarding. Questions: legal@waveform.vision.
1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the WaveForm platform, mobile applications, APIs, and related services (collectively, the “Services”), operated by Polaris EcoSystems (“WaveForm”, “we”, “us”). By creating an account or using the Services, you agree to these Terms.
2. Accounts
You are responsible for safeguarding your account credentials and for all activity under your account, including activity by robots and devices you register. Notify us promptly of any unauthorized use.
3. Acceptable use
Your use of the Services is subject to our Acceptable Use Policy. You may not use the Services to violate law, infringe rights, or compromise the safety of autonomous systems.
4. Customer data
You retain ownership of the captures, models, navigation packs, and other content you upload or generate (“Customer Data”). You grant us a limited license to process Customer Data solely to provide and improve the Services. Our handling of personal data is described in the Privacy Policy and, where applicable, the Data Processing Agreement.
5. Service levels
Availability commitments, where offered, are set out in the Service Level Agreement.
6. Fees
Paid plans are billed per the pricing in effect at purchase. Fees are non-refundable except as required by law or expressly stated in an order form.
7. Disclaimers
The Services are provided “as is.” WaveForm outputs — including change-detection alerts, 3D models, and navigation packs — are decision-support tools. You are responsible for validating outputs before relying on them in safety-critical operations.
8. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages. Final liability terms are set in your executed agreement.
9. Termination
Either party may terminate per the executed agreement. On termination we will make Customer Data available for export for a reasonable period, then delete it subject to our retention obligations.
